REGULAMIN SKLEPU INTERNETOWEGO
Niniejszy Regulamin określa ogólne warunki, zasady oraz sposób Sprzedaży prowadzonej przez YOGATTRACTIVE OLGA SZEMLEY – GOUDINEAU OLIVIER GOUDINEAU SPÓŁKA JAWNA ul. Paryska 17/ 17 03-945 Warszawa NIP 1133027990 REGON 388247866 , za pośrednictwem sklepu internetowego www.jogatwarzy.com (zwanego dalej: „Sklepem”) oraz określa zasady i warunki świadczenia przez Yogattractive nieodpłatnych drogą elektroniczną.
INFORMACJE PODSTAWOWE
1 Sklep internetowy Yogattractive.com, działający pod adresem http://www.jogatwarzy.com oraz sprzedaż w nim towarów drogą elektroniczną, prowadzone są przez spółkę prawa handlowego pod firmą YOGATTRACTIVE OLGA SZEMLEY – GOUDINEAU OLIVIER GOUDINEAU SPÓŁKA JAWNA ul. Paryska 17/ 17 03-945 Warszawa NIP 1133027990 REGON 388247866, dalej zwaną „Sprzedającym”.

4 Obsługa mailowa sklepu internetowego dostępna jest dla Klientów w dni robocze (od poniedziałku do piątku) w godzinach: 9:00 – 21:00.
5 Sprzedaż towarów drogą elektroniczną odbywa się w oparciu i zgodnie z:
a ustawą z dn. 18.07.2002 r. o świadczeniu usług drogą elektroniczną (Dz.U. z 2002 r. nr 144 poz. 1204 z póź. zm.);
b ustawą z dn. 30.05.2014 r. o prawach konsumenta (Dz.U. z 2014 r. poz. 827 z póź. zm.);
c ustawą z dn. 23.04.1964 r. Kodeks cywilny (Dz. U z 2014 r. poz. 121 z póź. zm.);
d niniejszym Regulaminem, który wydany został w trybie art. 8 ust. 1 pkt. 1 ustawy o świadczeniu usług drogą elektroniczną.
6 Regulamin określa:
a rodzaj i zakres usług świadczonych drogą elektroniczną;
b zasady korzystania ze sklepu internetowego Sprzedającego;
c warunki i tryb zawierania umów Sprzedaży drogą elektroniczną pomiędzy Sprzedającym a Klientem;
d ceny i warunki płatności kupowanego Towaru;
e warunki oraz sposób i termin dostawy zakupionego Towaru;
f warunki i tryb rozwiązywania/odstępowania od Umowy Sprzedaży przez Klienta;
g warunki i tryb rozwiązywania Umowy Sprzedaży przez Sprzedającego;
h tryb postępowania reklamacyjnego dotyczącego Towarów;
i tryb postępowania reklamacyjnego dotyczącego świadczenia usług drogą elektroniczną;
j wymagania techniczne, pod stronie Klienta, niezbędne dla realizacji tych usług oraz zawiera
k politykę prywatności i bezpieczeństwo danych Klienta;
l prawo rządzące Umowa Sprzedaży oraz właściwość miejscową sądu rozpatrującego ew. spór pomiędzy Sprzedającym a Klientem.
7 Klient może uzyskać treść niniejszego Regulaminu w każdym czasie przy wykorzystaniu odsyłacza zamieszczonego na stronie głównej serwisu www.jogatwarzy.com
8 Klient dokonuje akceptacji Regulaminu w sposób wskazany w rozdziale III pt. „Warunki i tryb zawierania Umów Sprzedaży”.
DEFINICJE
Użyte w Regulaminie pojęcia oznaczają:
1 Dostawa – oznacza czynność faktyczną polegającą na dostarczeniu Klientowi przez Sprzedającego, za pośrednictwem Dostawcy, Towaru określonego w Umowie Sprzedaży.
2 Dostawca – oznacza podmiot, z którym współpracuje Sprzedający w zakresie dokonywania Dostawy Towarów: firmę kurierską;
3 Klient – oznacza podmiot, na rzecz którego zgodnie z Regulaminem i przepisami prawa mogą być świadczone usługi drogą elektroniczną lub z którym zawarta może być Umowa Sprzedaży.
4 Konsument – oznacza osobę fizyczną dokonującą w Sklepie czynności prawnej niezwiązanej bezpośrednio z jej działalnością gospodarczą lub zawodową.
5 Sklep Internetowy (zwany dalej „Sklepem”) – serwis internetowy dostępny pod adresem http://www.jogatwarzy.com, za pośrednictwem którego Klient może w szczególności składać Zamówienia.
8 Towar – produkty prezentowane na stronie internetowej Sklepu.
9 Przedsiębiorca – oznacza osobę fizyczną, osobę prawną lub jednostkę organizacyjną niebędącą osobą prawną, której ustawa przyznaje zdolność prawną, prowadzącą we własnym imieniu działalność gospodarczą lub zawodową i dokonującą czynności prawnej związaną bezpośrednio z jej działalnością gospodarczą lub zawodową.
10 Zamówienie – oświadczenie woli Klienta, złożone Sprzedającemu w celu zawarcia Umowy Sprzedaży, określające w szczególności rodzaj i liczbę danego Towaru.
11 Umowa Sprzedaży – Umowa Sprzedaży Towaru(ów) na odległość, na zasadach określonych w Regulaminie, zawarta pomiędzy Sprzedającym a Klientem z wykorzystaniem serwisu internetowego Sklepu w wyniku oświadczenia Sprzedającego o przyjęciu do realizacji Zamówienia Klienta (oraz pod warunkiem, w przypadku wyboru płatności PayU, że zamówienie zostanie opłacone).
III. WARUNKI I TRYB ZAWIERANIA UMÓW SPRZEDAŻY
1 W celu zawarcia Umowy Sprzedaży za pośrednictwem Sklepu należy wejść na stronę internetową www.jogatwarzy.com, podejmując kolejne czynności w oparciu o wyświetlane komunikaty oraz informacje dostępne na tejże stronie, w tym podanie danych wskazanych tamże jako obowiązkowych.
2 W celu złożenia zamówienia w Sklepie za pośrednictwem strony internetowej Sklepu lub za pośrednictwem poczty elektronicznej oraz w celu korzystania z usług dostępnych na stronach internetowych Sklepu, konieczne jest posiadanie przez Klienta aktywnego konta poczty elektronicznej.
3 Klient dokonuje wyboru zamawianych Towarów poprzez ich dodanie do koszyka.
4 Po wypełnieniu przez Klienta wszystkich pól w żądane dane, wyświetlone zostanie podsumowanie składanego Zamówienia zawierające opis wybranych Towarów, ich łączną cenę oraz wszystkie inne koszty związanych z jego realizacją.
5 Do momentu naciśnięcia pola potwierdzającego złożenie Zamówienia – Klient ma możliwość modyfikacji wprowadzonych danych także w zakresie wyboru Towaru postępując zgodnie z wyświetlanymi komunikatami oraz informacjami.
6 Przed wysłaniem Zamówienia (poprzez naciśnięcie pola potwierdzającego jego złożenie) Klient potwierdza także, że akceptuje treść Regulaminu.
7 Informacje o Towarach podane na stronach internetowych Sklepu nie stanowią oferty Sprzedającego w rozumieniu przepisów ustawy Kodeks Cywilny, a jedynie zaproszenie Klientów do składania ofert zawarcia Umowy Sprzedaży.
8 Zamówienie Klienta traktowane jest (o ile jest zgodne z Regulaminem) jako oferta zakupu Towarów.
9 Jeśli Konsument złożył oświadczenie o rezygnacji z zawarcia Umowy Sprzedaży zanim Sprzedający przyjął jego ofertę, oferta przestaje wiązać Konsumenta.
10 Klient może składać zamówienia w Sklepie za pośrednictwem strony internetowej Sklepu przez 7 dni w tygodniu, 24 godziny na dobę.
11 Umowę Sprzedaży uważa się za zawartą z momentem wysłania oświadczenia przez Sprzedającego z jego systemu informatycznego na wskazany przez Klienta jego adres internetowy potwierdzającego przyjęcie Zamówienia do realizacji (z zastrzeżeniem, że w przypadku wyboru płatności PayU, dla zawarcia Umowy Sprzedaży konieczne jest, aby zamówienie zostało opłacone), które to oświadczenie Sprzedający wysyła najpóźniej w następnym dniu roboczym po wpływie Zamówienia.
12 Sprzedający może odmówić zawarcia Umowy Sprzedaży z osobą, która nie ukończyła 18 lat, o czym potencjalny Klient zostanie powiadomiony.
13 Sprzedający może wprowadzić limit ilości sztuk zakupu Towaru. Może też wprowadzić limit wartości nabycia Towaru w przypadku wskazania przez Klienta płatności w trybie „za pobraniem”.
14 Sprzedający może odmówić Klientowi zawarcia Umowy Sprzedaży, jak również może ograniczyć jego dostęp do części lub wszystkich Towarów, w przypadku naruszenia przez Klienta Regulaminu, a w szczególności, gdy Klient:
a naruszył dobra osobistych osób trzecich, w szczególności dobra osobistych innych Klientów;
b dopuścił się innych zachowań, które zostaną uznane przez Sprzedającego jako zachowania niezgodne z obowiązującymi przepisami prawa lub ogólnymi zasadami korzystania z sieci Internet lub godzące w dobre imię Sprzedającego.
15 Klient zobowiązany jest w szczególności do:
a korzystania ze Sklepu w sposób nie zakłócający jego funkcjonowania, w tym poprzez korzystanie ze wskazanych urządzeń i oprogramowania;
b korzystania ze Sklepu w sposób zgodny z: przepisami obowiązującymi w Polsce, postanowieniami Regulaminu, a także z ogólnymi zasadami korzystania z sieci Internet.
16 Klienta obowiązuje zakaz:
a rozsyłania i/lub umieszczanie w ramach Sklepu niezamówionej informacji handlowej (spam);
b odsprzedaży Towaru kupionego w Sklepie w ramach prowadzonej przez siebie działalności gospodarczej.
CENY I WARUNKI PŁATNOŚCI KUPOWANEGO TOWARU
1 Ceny Towarów podawane są w polskich złotych i zawierają wszystkie składniki, w tym podatek VAT (ze wskazaniem jego stawki).
2 Klient może uiścić cenę:
a za pobraniem (dodatkowa opłata w wysokości 15 zł), jeżeli w danej chwili taka opcja wyświetla się na stronie Sklepu przy zakupie Towaru lub
b kartą płatniczą lub przelewem bankowym poprzez zewnętrzny system szybkich płatności PayU lub Tpay.
WARUNKI ORAZ SPOSÓB I TERMINY DOSTAWY ZAKUPIONEGO TOWARU
1 Dostawa Towarów jest ograniczona do Unii Europejskiej. Dostawy w Polsce realizujemy za pośrednictwem firmy InPost, a w pozostałej części Europy za pośrednictwem firmy UPS. Proszę zobaczyć szczegóły dla Polski poniżej i wprowadzić swój kraj zamieszkania poza Polską, aby poznać koszt dostawy poza Polską
2 Zamówione Towary są dostarczane do Klienta za pośrednictwem Dostawcy na adres
3 Dostawa kupionych Towarów może być zrealizowana na terenie Polski za pośrednictwem (wybór należy do Klienta):
a firmy kurierskiej INPOST kurier (koszt 15 zł), INPOST PACZKOMAT (koszt 15 zł)
b odbiór osobisty
4 Termin wysyłki przez Sprzedawcę zakupionego Towaru (z zastrzeżeniem postanowień pkt 5 poniżej) wynosi maksymalnie 3 dni robocze liczone od:
a następnego dnia po dniu wysłania Klientowi, przez Sprzedającego, oświadczenia o przyjęciu Zamówienia do realizacji – w przypadku wyboru przez Klienta formy płatności „za pobraniem”;
b momentu wpłynięciu pełnej Ceny na konto Sprzedającego – w przypadku wyboru przez Klienta płatności PayU, Tpay lub PayPal.
5 Czas Dostawy Towaru Klientowi przez Dostawcę wynosi na terenie Polski:
a przez firmę kurierskej InPost: ok. 3 – 4 dni robocze;
b odbiór osobisty – następnego dnia roboczego w przypadku wyboru przez Klienta płatności PayU, Tpay lub PayPal.
6 Klient jest zobowiązany do zbadania dostarczonej przesyłki w czasie i w sposób typowy dla przesyłek danego rodzaju. W przypadku stwierdzenia wady lub uszkodzenia przesyłki, Klient ma prawo do zwrotu produktu (kontakt ze sprzedawcą pod adresem shop@yogattractive.com).
7 Sprzedający dołącza do przesyłki będącej przedmiotem Dostawy paragon fiskalny lub na życzenie fakturę VAT.
WARUNKI I TRYB ROZWIĄZYWANIA/ODSTĘPOWANIA OD UMOWY SPRZEDAŻY PRZEZ KLIENTA
1 Klient będący Konsumentem, który zawarł Umowę Sprzedaży, ma prawo odstąpić od Umowy w terminie 14 dni bez podania jakiejkolwiek przyczyny (z zastrzeżeniem poniższych postanowień).
2 Termin do odstąpienia od Umowy Sprzedaży wygasa po upływie 14 dni od dnia, w którym Klient, domownik Klienta lub wskazana przez niego osoba trzecia, odebrała przesyłkę z Towarem od Dostawcy.
3 Aby skutecznie odstąpić od Umowy sprzedaży, Klient musi przesłać Sprzedającemu jednoznaczne pisemne oświadczenie o odstąpieniu, najlepiej pocztą elektroniczną (shop@yogattractive.com) lub listownie na adres Sprzedającego (Yogattractive, Paryska 17/17, 03-945 Warszawa). Oświadczenie Klienta musi zawierać informacje określone w formularzu odstąpienia od Umowy Sprzedaży, którego wzór ustawowy znajduje się w załączniku do niniejszych Warunków.
4 W przypadku odstąpienia od Umowy Sprzedaży, jest ona uważana za niezawartą.
5 W przypadku wysłania oświadczenia o odstąpieniu od Umowy, Sprzedający niezwłocznie wyśle Klientowi, na trwałym nośniku np. pocztą elektroniczną, potwierdzenie otrzymania tego oświadczenia.
6 Dla zachowania terminu do odstąpienia od Umowy Sprzedaży wystarczy, aby Klient wysłał przedmiotowe oświadczenie przed upływem terminu, o którym mowa w pkt. 2 powyżej.
7 W przypadku odstąpienia od Umowy Sprzedaży Sprzedający zwraca Klientowi całą otrzymaną należność.
8 Zwrot należności nastąpi niezwłocznie, ale nie później niż 14 dni od dnia, w którym Sprzedający otrzymał od Klienta oświadczenie o odstąpieniu od Umowy Sprzedaży (z zastrzeżeniem postanowienia pkt. 12 poniżej).
9 Zwrot należności nastąpi przy użyciu takiego samego sposobu płatności, jaką zastosowała Klient płacąc za kupiony Towar, chyba że Strony uzgodnią inne rozwiązanie.
10 Klient zobowiązany jest zwrócić Sprzedającemu Towar na swój koszt niezwłocznie, ale nie później niż wciągu 14 dni od dnia, w którym odstąpił od Umowy Sprzedaży, za pośrednictwem poczty lub innego uzgodnionego przewoźnika. Zwracany Towar należy dostarczyć lub przesłać na adres: Yogattractive. Paryska 17/17 03-945 Warszawa
11 Sprzedający może wstrzymać się ze zwrotem należności Klientowi do chwili otrzymania Towaru z powrotem lub dostarczenia przez Klienta dowodu jego odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.
12 Prawo odstąpienia od Umowy Sprzedaży nie przysługuje Klientowi będącemu Konsumentem w odniesieniu do umów, w których Towarem jest rzecz dostarczana w zapieczętowanym opakowaniu, której po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu.
13 Klientowi do czasu odbioru Towaru przysługuje umowne prawo odstąpienia od Umowy Sprzedaży zgodnie z art. 395 Kodeksu Cywilnego. Prawo to Klient może wykonać składając oświadczenie Sprzedającemu. Powyższe Umowne prawo odstąpienia jest niezależne, nie narusza ani nie ogranicza prawa odstąpienia od Umowy w terminie 14 dni na podstawie ustawy o prawach konsumenta, opisanego w pkt. 1 i 2 powyżej.
VII. WARUNKI I TRYB ROZWIĄZYWANIA UMOWY SPRZEDAŻY PRZEZ SPRZEDAJĄCEGO
1 W przypadku wyboru przez Klienta formy płatności w systemie PayU lub Tpay – Sprzedający może odstąpić od Umowy Sprzedaży, jeśli należność nie wpłynie na jego konto w ciągu 7 dni od daty zawarcia Umowy Sprzedaży.
2 Oświadczenie Sprzedającego o odstąpieniu od Umowy Sprzedaży wysyłane jest Klientowi pocztą elektroniczną.
VIII. TRYB POSTĘPOWANIA REKLAMACYJNEGO DOTYCZĄCEGO TOWARÓW
1 Sprzedający odpowiada wobec Klienta (będącego konsumentem w rozumieniu art. 22[1] Kodeksy Cywilnego) z tytułu rękojmi za wady w zakresie określonym w Kodeksie Cywilnym.
2 Jeżeli Towar ma wadę, Klient może:
a złożyć oświadczenie o obniżeniu ceny albo odstąpieniu od Umowy Sprzedaży, chyba, że Sprzedający niezwłocznie i bez nadmiernych niedogodności dla Klienta wymieni Towar wadliwy na wolny od wad.
b Ograniczenie to nie ma zastosowania, jeżeli Towar był już wymieniony przez Sprzedającego albo Sprzedający nie uczynił zadość obowiązkowi wymiany Towaru na wolny od wad.
c żądać wymiany Towaru wadliwego na wolny od wad. Sprzedający jest obowiązany wymienić Towar wadliwy na wolny od wad w rozsądnym czasie bez nadmiernych niedogodności dla Klienta.
3 Sprzedający może odmówić zadośćuczynienia żądaniu Klienta, jeżeli doprowadzenie do zgodności z Umową Sprzedaży Towaru wadliwego w sposób wybrany przez Klienta jest niemożliwe lub w porównaniu z drugim możliwym sposobem doprowadzenia do zgodności z Umową Sprzedaży wymagałoby nadmiernych kosztów. Koszty wymiany ponosi Sprzedający.
4 Reklamacje należy kierować na poniższy adres magazynów Sprzedawcy: najlepiej mailowo na adres shop@yogattractive.com lub listownie na adres: Yogattractive, Paryska 17/17, 03-945 Warszawa. Sprzedawca rozpatrzy je w ciągu 14 dni.
5 W wypadku Klienta będącego Konsumentem koszt dostarczenia reklamowanego Towaru pokrywa Sprzedający.
6 Produkty użytku osobistego sprzedawane w zapieczętowanych opakowaniach, takie jak roller galwaniczny, nie podlegają zwrotowi po otwarciu opakowania
TRYB POSTĘPOWANIA REKLAMACYJNEGO DOTYCZĄCEGO ŚWIADCZENIA USŁUG DROGĄ ELEKTRONICZNĄ
1 Sprzedający zapewnia że podejmie działania, aby Sklep działał poprawnie biorąc pod uwagę aktualny stan wiedzy technicznej i wykorzystywanego sprzętu oraz oprogramowania, usuwając wszelkie ew. nieprawidłowości zgłoszone przez Klientów.
2 Klient może zgłosić Sprzedającemu reklamację w związku z nieprawidłowościami związanymi z funkcjonowaniem Sklepu. Klienci mogą zgłaszać reklamacje pisemnie na adres Sprzedającego (Yogattractive. Paryska 17/17 03-945 Warszawa ) lub adres: shop@Yogattractive.com, podając ich opis i datę wystąpienia.
3 Sprzedający zobowiązuje się do rozpatrzenia każdej takiej reklamacji w terminie 14 dni lub innym terminie, o którym poinformuje Klienta. Sprzedający usunie wskazane nieprawidłowości w najkrótszym technicznie możliwym terminie.
WYMAGANIA TECHNICZNE SPRZĘTU UŻYTKOWANEGO PRZEZ KLIENTA
1 Aby dokonać zakupu w Sklepie, Klient powinien mieć dostęp do stanowiska komputerowego lub urządzenia końcowego, z dostępem do Internetu.
2 Urządzenia te muszą spełniać następujące minimalne wymagania techniczne:
a Internet Explorer w wersji MSIE 8.x lub nowszej,
b Firefox w wersji 7.x lub nowszej,
c Chrome 15.x,
d minimalna rozdzielczość ekranu 1024 x 768 pikseli.
XI.DODATKOWE INFORMACJE HANDLOWE
Sprzedający na swoich stronach internetowych informować będzie Klientów o aktualnych działaniach promocyjnych, w tym obniżkach cen lub innych korzyści związanych z promowanym Towarem, określając czas ich trwania oraz warunki niezbędnych do skorzystania z tej promocji.
XII.DODATKOWY (USTAWOWY) ZAKAZ OBOWIĄZUJĄCY KUPJĄCEGO
Klient zobowiązany jest przestrzegać ustawowego zakazu umieszczenia w systemie teleinformatycznym Sprzedającego treści o charakterze bezprawnym, w tym zniesławiających lub naruszających dobra osobiste i inne prawa osób trzecich.
XIV. OCHRONA DANYCH OSOBOWYCH KLIENTÓW
1 Sprzedający jest Administratorem danych osobowych Klientów przekazanych Sprzedającemu dobrowolnie w ramach złożonego zamówienia.
2 Sprzedający przetwarza dane osobowe Klientów w celu realizacji zamówień. Dane są przetwarzane wyłącznie na podstawie przepisów prawa lub zgody wyrażonej przez Klienta zgodnie z obowiązującymi przepisami prawa.
3 Zbiór danych osobowych przekazanych Sprzedającemu zgłaszany jest przez Sprzedającego Generalnemu Inspektorowi Ochrony Danych Osobowych.
4 Klient przekazuje swoje dane osobowe Sprzedającemu dobrowolnie, z tym jednak zastrzeżeniem, że niepodanie określonych danych w procesie Rejestracji uniemożliwia Rejestrację i założenie Konta Klienta oraz uniemożliwia złożenie i realizację zamówienia Klienta, w przypadku składania zamówienia bez Rejestracji Konta Klienta.
5 Każdy kto przekaże Sprzedającemu swoje dane osobowe, ma prawo dostępu do ich treści oraz do ich poprawiania lub żądania ich usunięcia, a w przypadkach przewidzianych przepisami prawa żądania zaprzestania przetwarzania jego danych osobowych.
6 Sprzedający zapewnia możliwość usunięcia danych osobowych z prowadzonego zbioru, w szczególności w przypadku usunięcia Konta Klienta. Sprzedający może odmówić usunięcia danych osobowych, jeżeli Klient nie uregulował wszystkich należności wobec Sprzedającemu lub naruszył obowiązujące przepisy prawa, a zachowanie danych osobowych jest niezbędne do wyjaśnienia tych okoliczności i ustalenia odpowiedzialności Klienta.
7 Sprzedający chroni przekazane mu dane osobowe oraz dokłada wszelkich starań w celu zabezpieczenia ich przed nieuprawnionym dostępem lub wykorzystaniem przez osoby nieupoważnione.
8 Sprzedający przekazuje dane osobowe Klienta Dostawcy w zakresie niezbędnym do realizacji Dostawy.
XVI. POSTANOWIENIA KOŃCOWE
1 Nie jest dopuszczalne wykorzystywanie zasobów i funkcji Sklepu w celu prowadzenia przez Klienta działalności, która naruszałaby interes Sprzedającego.
2 Wszelkie prawa do Sklepu, w tym majątkowe prawa autorskie, prawa własności intelektualnej do jego nazwy, jego domeny internetowej, strony internetowej Sklepu, a także do wzorców, formularzy, logotypów i zdjęć zamieszczanych na stronie internetowej Sklepu należą do Sprzedającego lub podmiotów z nim współpracujących.
3 Sprzedający stosuje mechanizm plików „cookies”, które podczas korzystania przez Klientów ze strony internetowej Sklepu, zapisywane są przez serwer Sprzedającemu na dysku twardym urządzenia końcowego Klienta. Stosowanie plików „cookies” ma na celu poprawne działanie strony internetowej Sklepu na urządzeniach końcowych Klientów. Mechanizm ten nie niszczy urządzenia końcowego Klienta oraz nie powoduje zmian konfiguracyjnych w urządzeniach końcowych Klientów ani w oprogramowaniu zainstalowanym na tych urządzeniach. Każdy Klient może wyłączyć mechanizm „cookies” w przeglądarce internetowej swojego urządzenia końcowego. Sprzedający wskazuje, że wyłączenie „cookies” może jednak spowodować utrudnienia lub uniemożliwić korzystanie ze strony internetowej Sklepu.
4 Sprzedający ponosi odpowiedzialność z tytułu niewykonania lub nienależytego wykonania Umowy, lecz w przypadku umów zawieranych z Klientami będącymi Przedsiębiorcami Sprzedający ponosi odpowiedzialność tylko w przypadku umyślnego wyrządzenia szkody i w granicach rzeczywiście poniesionych strat przez Klienta będącego Przedsiębiorcą.
5 Rozstrzyganie ewentualnych sporów powstałych pomiędzy Sprzedającym a Klientem, który jest Konsumentem w rozumieniu art. 22[1] Kodeksu Cywilnego, zostaje poddane sądom właściwym zgodnie z postanowieniami Kodeksu postępowania cywilnego.
6 Rozstrzyganie ewentualnych sporów powstałych pomiędzy Sprzedającym a Klientem, który nie jest Konsumentem w rozumieniu art. 22[1] Kodeksu Cywilnego zostaje poddane sądowi właściwemu ze względu na siedzibę Sprzedającego.
7 Klient będący Konsumentem może również skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń poprzez złożenie swojej skargi za pośrednictwem unijnej platformy internetowej ODR, dostępnej pod adresem: http://ec.europa.eu/consumers/odr/
8 W sprawach nieuregulowanych w niniejszym Regulaminie mają zastosowanie przepisy wskazane w pkt. I.3 tegoż Regulaminu.
9 Sprzedający zastrzega sobie prawo zmiany niniejszego Regulaminu. Wszystkie Zamówienia przyjęte przez Sprzedającego do realizacji przed dniem wejścia w życie nowego Regulaminu są realizowane na podstawie dotychczasowego Regulaminu (który obowiązywał w chwili zawarcia Umowy Sprzedaży). Zmieniony Regulamin wchodzi w życie w terminie 14 dni od dnia jego opublikowania na Stronie Internetowej Sklepu.
Terms and Conditions
These Terms and Conditions specify the general terms, rules and manner of sales conducted by YOGATTRACTIVE OLGA SZEMLEY – GOUDINEAU OLIVIER GOUDINEAU SPÓŁKA JAWNA, ul. Paryska 17/17, 03-945 Warsaw, NIP 1133027990, REGON 388247866, through the online store www.jogatwarzy.com (hereinafter referred to as the “Store”), and specify the terms and conditions for the provision of free electronic services by Yogattractive.
BASIC INFORMATION
- The Yogattractive.com online store, operating at http://www.jogatwarzy.com, and the electronic sale of goods through it are operated by the commercial partnership YOGATTRACTIVE OLGA SZEMLEY – GOUDINEAU OLIVIER GOUDINEAU SPÓŁKA JAWNA, ul. Paryska 17/17, 03-945 Warsaw, NIP 1133027990, REGON 388247866, hereinafter referred to as the “Seller”.
- The electronic address of the Seller’s online store is: www.jogatwarzy.com.

- Email support for the online store is available to Customers on business days (Monday to Friday) between 9:00 a.m. and 9:00 p.m.
- The electronic sale of goods is carried out on the basis of and in accordance with:
a. the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws of 2002, No. 144, item 1204, as amended);
b. the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended);
c. the Act of 23 April 1964 – Civil Code (Journal of Laws of 2014, item 121, as amended);
d. these Terms and Conditions, issued pursuant to Article 8(1)(1) of the Act on the Provision of Electronic Services.
- These Terms and Conditions specify:
a. the type and scope of services provided electronically;
b. the rules for using the Seller’s online store;
c. the terms and procedure for concluding Sales Agreements electronically between the Seller and the Customer;
d. the prices and payment terms for purchased Goods;
e. the terms, method and delivery time for purchased Goods;
f. the terms and procedure for termination/withdrawal from the Sales Agreement by the Customer;
g. the terms and procedure for termination of the Sales Agreement by the Seller;
h. the complaints procedure concerning Goods;
i. the complaints procedure concerning the provision of electronic services;
j. the technical requirements on the Customer’s side necessary for the provision of such services;
k. the privacy policy and security of Customer data;
l. the law governing the Sales Agreement and the territorial jurisdiction of the court hearing any dispute between the Seller and the Customer.
- The Customer may access these Terms and Conditions at any time via the link provided on the home page of www.jogatwarzy.com.
- The Customer accepts these Terms and Conditions in the manner specified in Section III entitled “Terms and Procedure for Concluding Sales Agreements”.
DEFINITIONS
The terms used in these Terms and Conditions shall have the following meanings:
- Delivery – the factual act of delivering to the Customer, by the Seller through the Delivery Provider, the Goods specified in the Sales Agreement.
- Delivery Provider – an entity cooperating with the Seller in delivering Goods: a courier company.
- Customer – an entity to whom, in accordance with these Terms and Conditions and applicable law, electronic services may be provided or with whom a Sales Agreement may be concluded.
- Consumer – a natural person performing a legal transaction in the Store that is not directly related to their business or professional activity.
- Online Store (hereinafter referred to as the “Store”) – the website available at http://www.jogatwarzy.com, through which the Customer may, in particular, place Orders.
- Goods – products presented on the Store’s website.
- Entrepreneur – a natural person, legal person or organisational unit without legal personality to which the law grants legal capacity, conducting business or professional activity in its own name and performing a legal transaction directly related to such business or professional activity.
- Order – the Customer’s declaration of intent submitted to the Seller for the purpose of concluding a Sales Agreement, specifying in particular the type and quantity of the Goods concerned.
- Sales Agreement – a distance sales agreement for Goods, concluded under the terms set out in these Terms and Conditions between the Seller and the Customer using the Store’s website, as a result of the Seller’s declaration accepting the Customer’s Order for fulfilment (and, where PayU payment is selected, provided that the Order has been paid for).
III. TERMS AND PROCEDURE FOR CONCLUDING SALES AGREEMENTS
- In order to conclude a Sales Agreement through the Store, the Customer must visit www.jogatwarzy.com and follow the successive steps based on the messages and information displayed on that website, including providing the information indicated there as mandatory.
- In order to place an Order in the Store via the Store’s website or by email, and to use services available on the Store’s website, the Customer must have an active email account.
- The Customer selects the Goods to be ordered by adding them to the shopping cart.
- Once the Customer has completed all required fields, a summary of the Order will be displayed, containing a description of the selected Goods, their total price and all other costs associated with fulfilment of the Order.
- Until the Customer clicks the button confirming placement of the Order, the Customer may modify the information entered, including the selection of Goods, by following the messages and information displayed.
- Before submitting the Order (by clicking the button confirming placement of the Order), the Customer also confirms acceptance of these Terms and Conditions.
- Information concerning Goods provided on the Store’s website does not constitute an offer by the Seller within the meaning of the Civil Code, but merely an invitation for Customers to submit offers to conclude a Sales Agreement.
- The Customer’s Order shall be treated, provided that it complies with these Terms and Conditions, as an offer to purchase the Goods.
- If a Consumer submits a declaration withdrawing from the conclusion of a Sales Agreement before the Seller has accepted the Consumer’s offer, the offer shall cease to be binding on the Consumer.
- Customers may place Orders through the Store’s website 24 hours a day, 7 days a week.
- The Sales Agreement shall be deemed concluded when the Seller sends, from its IT system to the email address specified by the Customer, a declaration confirming acceptance of the Order for fulfilment (provided that, where PayU payment is selected, payment for the Order is required for the Sales Agreement to be concluded). The Seller shall send such declaration no later than the next business day following receipt of the Order.
- The Seller may refuse to conclude a Sales Agreement with a person under 18 years of age, of which the prospective Customer shall be informed.
- The Seller may introduce a limit on the number of units of Goods that may be purchased. The Seller may also introduce a limit on the value of Goods purchased where the Customer selects cash on delivery as the payment method.
- The Seller may refuse to conclude a Sales Agreement with the Customer and may restrict the Customer’s access to some or all Goods if the Customer breaches these Terms and Conditions, in particular where the Customer:
a. infringes the personal rights of third parties, in particular the personal rights of other Customers;
b. engages in other conduct considered by the Seller to be contrary to applicable law, general principles of Internet use, or detrimental to the Seller’s good name.
- The Customer is required, in particular, to:
a. use the Store in a manner that does not interfere with its operation, including by using the indicated devices and software;
b. use the Store in accordance with the laws applicable in Poland, these Terms and Conditions, and generally accepted principles of Internet use.
- The Customer is prohibited from:
a. distributing and/or posting unsolicited commercial information (spam) within the Store;
b. reselling Goods purchased from the Store as part of the Customer’s own business activity.
PRICES AND PAYMENT TERMS FOR PURCHASED GOODS
- Prices of Goods are stated in Polish zloty and include all components, including VAT, with the applicable VAT rate indicated.
- The Customer may pay the price:
a. by cash on delivery (an additional fee of PLN 15), provided that this option is displayed on the Store’s website when purchasing the Goods; or
b. by payment card or bank transfer through the external PayU or Tpay instant payment system.
TERMS, METHOD AND DELIVERY TIMES FOR PURCHASED GOODS
- Delivery of Goods is limited to the European Union. Deliveries within Poland are carried out by InPost, while deliveries elsewhere in Europe are carried out by UPS. Please see the details for Poland below and enter your country of residence outside Poland to determine the delivery cost outside Poland.
- The ordered Goods are delivered to the Customer by the Delivery Provider to the specified address.
- Delivery of purchased Goods within Poland may be carried out using one of the following methods, as selected by the Customer:
a. InPost courier (cost: PLN 15) or INPOST PACZKOMAT parcel locker (cost: PLN 15);
b. personal collection.
- The Seller shall dispatch the purchased Goods, subject to point 5 below, within a maximum of 3 business days calculated from:
a. the day following the day on which the Seller sends the Customer a declaration accepting the Order for fulfilment – where the Customer has selected cash on delivery;
b. the moment the full Price is credited to the Seller’s account – where the Customer has selected PayU, Tpay or PayPal payment.
- The Delivery Provider’s delivery time for Goods within Poland is:
a. via InPost courier: approximately 3–4 business days;
b. personal collection – on the next business day where the Customer has selected PayU, Tpay or PayPal payment.
- The Customer is required to inspect the delivered shipment at the time and in the manner customary for shipments of the relevant type. If a defect or damage to the shipment is identified, the Customer has the right to return the product (contact the Seller at shop@yogattractive.com).
- The Seller shall include a fiscal receipt with the shipment being delivered or, upon request, a VAT invoice.
TERMS AND PROCEDURE FOR TERMINATION/WITHDRAWAL FROM THE SALES AGREEMENT BY THE CUSTOMER
- A Customer who is a Consumer and who has concluded a Sales Agreement has the right to withdraw from the Agreement within 14 days without giving any reason, subject to the provisions below.
- The period for withdrawal from the Sales Agreement expires 14 days after the day on which the Customer, a member of the Customer’s household or a third party designated by the Customer receives the shipment containing the Goods from the Delivery Provider.
- In order to validly withdraw from the Sales Agreement, the Customer must send the Seller an unequivocal written statement of withdrawal, preferably by email to shop@yogattractive.com or by post to the Seller’s address: Yogattractive, Paryska 17/17, 03-945 Warsaw. The Customer’s statement must contain the information specified in the withdrawal form, the statutory template of which is attached to these Terms and Conditions.
- In the event of withdrawal from the Sales Agreement, the Agreement shall be deemed not to have been concluded.
- Where a statement of withdrawal from the Agreement has been submitted, the Seller shall immediately send the Customer confirmation of receipt of the statement on a durable medium, for example by email.
- In order to comply with the deadline for withdrawal from the Sales Agreement, it is sufficient for the Customer to send the relevant statement before expiry of the period referred to in point 2 above.
- In the event of withdrawal from the Sales Agreement, the Seller shall reimburse the Customer for the full amount received.
- The reimbursement shall be made immediately, but no later than 14 days from the date on which the Seller receives the Customer’s statement of withdrawal from the Sales Agreement, subject to point 12 below.
- The reimbursement shall be made using the same payment method used by the Customer to pay for the purchased Goods, unless the Parties agree otherwise.
- The Customer is required to return the Goods to the Seller at the Customer’s own expense without undue delay and no later than 14 days from the date on which the Customer withdrew from the Sales Agreement, by post or another agreed carrier. The returned Goods must be delivered or sent to: Yogattractive, Paryska 17/17, 03-945 Warsaw.
- The Seller may withhold reimbursement until the Seller receives the Goods back or until the Customer provides proof that the Goods have been sent back, whichever occurs first.
- A Customer who is a Consumer shall not have the right to withdraw from a Sales Agreement concerning Goods supplied in sealed packaging which cannot be returned after the packaging has been opened for health protection or hygiene reasons, where the packaging was opened after delivery.
- Until receipt of the Goods, the Customer has a contractual right to withdraw from the Sales Agreement pursuant to Article 395 of the Civil Code. The Customer may exercise this right by submitting a declaration to the Seller. This contractual right of withdrawal is independent of, and does not infringe or restrict, the right to withdraw from the Agreement within 14 days under the Consumer Rights Act as described in points 1 and 2 above.
VII. TERMS AND PROCEDURE FOR TERMINATION OF THE SALES AGREEMENT BY THE SELLER
- Where the Customer has selected payment through PayU or Tpay, the Seller may withdraw from the Sales Agreement if payment is not credited to the Seller’s account within 7 days from the date on which the Sales Agreement was concluded.
- The Seller’s declaration of withdrawal from the Sales Agreement shall be sent to the Customer by email.
VIII. COMPLAINTS PROCEDURE CONCERNING GOODS
- The Seller shall be liable towards a Customer who is a Consumer within the meaning of Article 22¹ of the Civil Code under the statutory warranty for defects to the extent specified in the Civil Code.
- If the Goods are defective, the Customer may:
a. submit a statement requesting a price reduction or withdrawal from the Sales Agreement, unless the Seller immediately and without excessive inconvenience to the Customer replaces the defective Goods with defect-free Goods;
b. this limitation shall not apply if the Goods have already been replaced by the Seller or the Seller has failed to fulfil its obligation to replace the Goods with defect-free Goods;
c. request replacement of defective Goods with defect-free Goods. The Seller is required to replace defective Goods with defect-free Goods within a reasonable period and without excessive inconvenience to the Customer.
- The Seller may refuse to satisfy the Customer’s request if bringing the defective Goods into conformity with the Sales Agreement in the manner selected by the Customer is impossible or, compared with the other possible method of bringing the Goods into conformity with the Sales Agreement, would involve excessive costs. The costs of replacement shall be borne by the Seller.
- Complaints should be submitted to the following Seller’s warehouse address, preferably by email to shop@yogattractive.com or by post to: Yogattractive, Paryska 17/17, 03-945 Warsaw. The Seller shall consider complaints within 14 days.
- Where the Customer is a Consumer, the cost of delivering the Goods subject to complaint shall be borne by the Seller.
- Personal-use products sold in sealed packaging, such as the galvanic roller, cannot be returned once the packaging has been opened.
COMPLAINTS PROCEDURE CONCERNING THE PROVISION OF ELECTRONIC SERVICES
- The Seller shall take reasonable measures to ensure that the Store operates correctly, taking into account the current state of technical knowledge and the hardware and software used, and shall remedy any irregularities reported by Customers.
- The Customer may submit a complaint to the Seller concerning irregularities in the operation of the Store. Customers may submit complaints in writing to the Seller’s address: Yogattractive, Paryska 17/17, 03-945 Warsaw, or by email to shop@Yogattractive.com, providing a description of the irregularity and the date on which it occurred.
- The Seller undertakes to consider each such complaint within 14 days or within another period of which the Customer shall be informed. The Seller shall remedy the reported irregularities within the shortest period technically possible.
TECHNICAL REQUIREMENTS FOR EQUIPMENT USED BY THE CUSTOMER
- In order to make a purchase in the Store, the Customer should have access to a computer workstation or terminal device with Internet access.
- Such devices must meet the following minimum technical requirements:
a. Internet Explorer version MSIE 8.x or later;
b. Firefox version 7.x or later;
c. Chrome 15.x;
d. minimum screen resolution of 1024 × 768 pixels.
XI. ADDITIONAL COMMERCIAL INFORMATION
The Seller shall inform Customers on its websites about current promotional activities, including price reductions or other benefits associated with promoted Goods, specifying the duration of the promotion and the conditions that must be met in order to benefit from it.
XII. ADDITIONAL STATUTORY PROHIBITION APPLICABLE TO THE BUYER
The Customer is required to comply with the statutory prohibition against placing unlawful content in the Seller’s ICT system, including defamatory content or content infringing the personal rights or other rights of third parties.
XIV. PROTECTION OF CUSTOMERS’ PERSONAL DATA
- The Seller is the Controller of Customers’ personal data voluntarily provided to the Seller in connection with an Order.
- The Seller processes Customers’ personal data for the purpose of fulfilling Orders. Data is processed solely on the basis of applicable law or consent provided by the Customer in accordance with applicable law.
- The database of personal data provided to the Seller is reported by the Seller to the Inspector General for Personal Data Protection.
- The Customer provides their personal data to the Seller voluntarily, subject to the proviso that failure to provide certain data during the Registration process prevents Registration and creation of a Customer Account and prevents the Customer from placing and having an Order fulfilled where an Order is placed without registering a Customer Account.
- Anyone who provides their personal data to the Seller has the right to access such data and to correct it or request its deletion and, in cases provided for by law, to request that the processing of their personal data be discontinued.
- The Seller provides the possibility of deleting personal data from the database it maintains, in particular in the event that the Customer Account is deleted. The Seller may refuse to delete personal data if the Customer has not settled all amounts due to the Seller or has breached applicable law and retaining the personal data is necessary to clarify such circumstances and determine the Customer’s liability.
- The Seller protects the personal data provided to it and makes every effort to protect such data against unauthorised access or use by unauthorised persons.
- The Seller provides the Customer’s personal data to the Delivery Provider to the extent necessary to carry out Delivery.
XVI. FINAL PROVISIONS
- The Customer may not use the Store’s resources or functions for the purpose of conducting activities that would infringe the Seller’s interests.
- All rights to the Store, including economic copyrights and intellectual property rights to its name, Internet domain, Store website, as well as templates, forms, logos and photographs published on the Store’s website, belong to the Seller or entities cooperating with the Seller.
- The Seller uses “cookies”, which are stored by the Seller’s server on the hard drive of the Customer’s terminal device while the Customer uses the Store’s website. Cookies are used to ensure the proper operation of the Store’s website on Customers’ terminal devices. This mechanism does not damage the Customer’s terminal device and does not modify the configuration of Customers’ terminal devices or the software installed on them. Each Customer may disable cookies in the web browser on their terminal device. The Seller notes, however, that disabling cookies may make it difficult or impossible to use the Store’s website.
- The Seller shall be liable for failure to perform or improper performance of the Agreement; however, in the case of agreements concluded with Customers who are Entrepreneurs, the Seller shall be liable only in the event of intentional damage and only up to the amount of losses actually incurred by the Customer who is an Entrepreneur.
- Any disputes arising between the Seller and a Customer who is a Consumer within the meaning of Article 22¹ of the Civil Code shall be submitted to the courts having jurisdiction in accordance with the provisions of the Code of Civil Procedure.
- Any disputes arising between the Seller and a Customer who is not a Consumer within the meaning of Article 22¹ of the Civil Code shall be submitted to the court having jurisdiction over the Seller’s registered office.
- A Customer who is a Consumer may also use out-of-court complaint and redress procedures by submitting a complaint through the EU Online Dispute Resolution (ODR) platform available at: http://ec.europa.eu/consumers/odr/.
- In matters not regulated by these Terms and Conditions, the provisions indicated in point I.3 of these Terms and Conditions shall apply.
- The Seller reserves the right to amend these Terms and Conditions. All Orders accepted by the Seller for fulfilment before the date on which the new Terms and Conditions enter into force shall be fulfilled on the basis of the previous Terms and Conditions applicable at the time the Sales Agreement was concluded. The amended Terms and Conditions shall enter into force 14 days after their publication on the Store’s Website.
