TERMS AND CONDITIONS OF THE ONLINE STORE

These Terms and Conditions set out the general terms, conditions, and manner of Sale conducted by YOGATTRACTIVE OLGA SZEMLEY – GOUDINEAU OLIVIER GOUDINEAU SPÓŁKA JAWNA ul. Paryska 17/ 17 03-945 Warsaw NIP 1133027990 REGON 388247866 , via the online storewww.jogatwarzy.com (hereinafter referred to as: "Store") and defines the terms and conditions of provision by Yogattractive free of charge by electronic means.

BASIC INFORMATION

1 The Yogattractive.com online store, operating athttp://www.jogatwarzy.com, and the electronic sale of goods therein, are operated by a commercial law company under the name YOGATTRACTIVE OLGA SZEMLEY – GOUDINEAU OLIVIER GOUDINEAU SPÓŁKA JAWNA ul. Paryska 17/ 17 03-945 Warsaw NIP 1133027990 REGON 388247866, hereinafter referred to as the "Seller."

4 The online store's email support is available to customers on business days (Monday through Friday) from 9:00 a.m. to 9:00 p.m.

5 The sale of goods by electronic means is based on and in accordance with:

a the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended);

b the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended);

c the Act of April 23, 1964, Civil Code (Journal of Laws of 2014, item 121, as amended);

d these Terms and Conditions, which were issued pursuant to Article 8(1)(1) of the Act on the provision of electronic services.

6 The regulations specify:

a the type and scope of services provided electronically;

b rules for using the Seller's online store;

c terms and conditions and procedure for concluding electronic Sales Agreements between the Seller and the Customer;

d prices and terms of payment for the purchased Goods;

e the terms and conditions, method, and date of delivery of the purchased Goods;

f terms and conditions and procedure for termination/withdrawal from the Sales Agreement by the Customer;

g terms and conditions and procedure for termination of the Sales Agreement by the Seller;

h the procedure for handling complaints regarding the Goods;

and the complaint procedure regarding the provision of electronic services;

j technical requirements, on the Customer's side, necessary for the performance of these services, and includes

k privacy policy and customer data security;

l The law governing the Sales Agreement and the local jurisdiction of the court hearing any dispute between the Seller and the Customer.

7 The customer may obtain the content of these Terms and Conditions at any time by using the link provided on the home page of the websitewww.jogatwarzy.com.

8 The Customer accepts the Terms and Conditions in the manner specified in Chapter III entitled "Terms and Conditions of Concluding Sales Agreements."

DEFINITIONS

The terms used in these Terms and Conditions shall have the following meanings:

1 Delivery – means the actual act of delivering the Goods specified in the Sales Agreement to the Customer by the Seller, through the Supplier.

2 Supplier – means an entity with which the Seller cooperates in the delivery of Goods: a courier company;

3 Customer – means an entity to which, in accordance with the Terms and Conditions and the provisions of law, services may be provided electronically or with which a Sales Agreement may be concluded.

4 Consumer – means a natural person performing a legal transaction in the Store that is not directly related to their business or professional activity.

5 Online Store (hereinafter referred to as the "Store") – a website available athttp://www.jogatwarzy.com, through which the Customer may, in particular, place Orders.

8 Goods – products presented on the Store's website.

9 Entrepreneur – means a natural person, legal person, or organizational unit that is not a legal person, to which the law grants legal capacity, conducting business or professional activity on its own behalf and performing legal actions directly related to its business or professional activity.

10 Order – a declaration of intent made by the Customer to the Seller for the purpose of concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.

11 Sales Agreement – A distance contract for the sale of Goods, on the terms set out in the Terms and Conditions, concluded between the Seller and the Customer using the Store's website as a result of the Seller's declaration of acceptance of the Customer's Order (and, if PayU payment is selected, provided that the order is paid for).

III. TERMS AND CONDITIONS OF SALE AGREEMENTS

1 In order to conclude a Sales Agreement via the Store, go to the websitewww.jogatwarzy.com and follow the instructions based on the messages displayed and the information available on that website, including providing the data indicated there as mandatory.

2 In order to place an order in the Store via the Store's website or via email, and in order to use the services available on the Store's websites, the Customer must have an active email account.

3. The Customer selects the ordered Goods by adding them to the shopping cart.

4 After the Customer has filled in all the required fields, a summary of the Order will be displayed, containing a description of the selected Goods, their total price, and all other costs related to its fulfillment.

5 Until the field confirming the Order is pressed, the Customer has the option to modify the entered data, including the selection of Goods, by following the displayed messages and information.

6 Before sending the Order (by clicking the button confirming its submission), the Customer also confirms that they accept the Terms and Conditions.

7 Information about Goods provided on the Store's website does not constitute an offer by the Seller within the meaning of the Civil Code, but only an invitation to Customers to submit offers to conclude a Sales Agreement.

8 The Customer's order is treated (provided that it complies with the Terms and Conditions) as an offer to purchase Goods.

9 If the Consumer has made a statement of withdrawal from the Sales Agreement before the Seller has accepted their offer, the offer ceases to be binding on the Consumer.

10 Customers may place orders in the Store via the Store's website 24 hours a day, 7 days a week.

11 The Sales Agreement shall be deemed concluded upon the Seller sending a statement from its IT system to the email address provided by the Customer confirming acceptance of the Order for execution (with the proviso that if PayU payment is selected, the order must be paid for in order for the Sales Agreement to be concluded), which statement the Seller sends no later than on the next business day after receiving the Order.

12 The Seller may refuse to conclude a Sales Agreement with a person under the age of 18, of which the potential Customer will be notified.

13 The Seller may introduce a limit on the quantity of Goods that can be purchased. The Seller may also introduce a limit on the value of Goods purchased if the Customer chooses to pay by cash on delivery.

14 The Seller may refuse to conclude a Sales Agreement with the Customer and may restrict the Customer's access to some or all of the Goods in the event of a breach of the Terms and Conditions by the Customer, in particular if the Customer:

a violated the personal rights of third parties, in particular the personal rights of other Customers;

b has engaged in other behavior that will be considered by the Seller as behavior that is inconsistent with applicable law or general principles of Internet use, or that damages the Seller's reputation.

15 The Customer is obliged in particular to:

a use the Store in a manner that does not disrupt its functioning, including by using the specified devices and software;

b use the Store in a manner consistent with: the regulations in force in Poland, the provisions of the Terms and Conditions, as well as the general rules for using the Internet.

16 The customer is prohibited from:

a sending and/or posting unsolicited commercial information (spam) within the Store;

b resale of Goods purchased in the Store as part of their business activities.

PRICES AND PAYMENT TERMS FOR PURCHASED GOODS

1 Prices of Goods are given in Polish zlotys and include all components, including VAT (with an indication of its rate).

2 The customer may pay the price:

a cash on delivery (additional fee of PLN 15), if this option is currently displayed on the Store's website when purchasing the Goods, or

b payment card or bank transfer via the external fast payment system PayU or Tpay.

TERMS AND CONDITIONS, METHOD AND DELIVERY TIMES FOR PURCHASED GOODS

1 Delivery of Goods is limited to the European Union. Deliveries in Poland are carried out by InPost, and in the rest of Europe by UPS. Please see the details for Poland below and enter your country of residence outside Poland to find out the cost of delivery outside Poland.

2 The ordered Goods are delivered to the Customer via the Supplier to the address

3 Delivery of purchased Goods may be carried out within Poland via (the choice is up to the Customer):

a INPOST courier service (cost: PLN 15), INPOST PACZKOMAT (cost: PLN 15)

b personal collection

4 The Seller shall ship the purchased Goods (subject to the provisions of section 5 below) within a maximum of 3 business days from:

a on the day following the day on which the Seller sent the Customer a statement confirming acceptance of the Order for execution – if the Customer chose the "cash on delivery" payment method;

b upon receipt of the full Price in the Seller's account – if the Customer chooses to pay via PayU, Tpay, or PayPal.

5 The time of delivery of goods to the customer by the supplier within Poland is:

a by InPost courier service: approx. 3–4 business days;

b personal collection – on the next business day if the Customer chooses PayU, Tpay, or PayPal payment.

6 The Customer is obliged to inspect the delivered shipment in a manner and within a time frame typical for shipments of this type. If a defect or damage to the shipment is found, the Customer has the right to return the product (contact the seller atshop@yogattractive.com).

7. The Seller shall attach a fiscal receipt or, upon request, a VAT invoice to the shipment being the subject of the Delivery.

TERMS AND CONDITIONS FOR TERMINATION/WITHDRAWAL FROM THE SALES AGREEMENT BY THE CUSTOMER

1 A Customer who is a Consumer who has concluded a Sales Agreement has the right to withdraw from the Agreement within 14 days without giving any reason (subject to the provisions below).

2 The deadline for withdrawing from the Sales Agreement expires after 14 days from the date on which the Customer, a member of the Customer's household, or a third party designated by the Customer received the shipment with the Goods from the Supplier.

3 In order to effectively withdraw from the Sales Agreement, the Customer must submit a written, unambiguous statement of withdrawal to the Seller, which should be sent by post to the Seller's address (Jogattractive. Paryska 17/17 03-945 Warsaw) or send the statement by e-mail (shop@yogattractive.com). The Customer's statement must contain the information specified in the Sales Agreement withdrawal form, a statutory template of which is attached to the Terms and Conditions.

4. In the event of withdrawal from the Sales Agreement, it shall be deemed not to have been concluded.

5. If a statement of withdrawal from the Agreement is sent, the Seller shall immediately send the Customer confirmation of receipt of this statement on a durable medium, e.g., by email.

6 In order to meet the deadline for withdrawing from the Sales Agreement, it is sufficient for the Customer to send the relevant statement before the deadline referred to in point 2 above.

7. In the event of withdrawal from the Sales Agreement, the Seller shall refund the Customer the entire amount received.

8 The refund shall be made immediately, but no later than 14 days from the date on which the Seller received the Customer's statement of withdrawal from the Sales Agreement (subject to the provisions of point 12 below).

9 The refund will be made using the same payment method that the Customer used to pay for the purchased Goods, unless the Parties agree otherwise.

10 The Customer is obliged to return the Goods to the Seller at their own expense immediately, but no later than within 14 days from the date on which they withdrew from the Sales Agreement, by post or another agreed carrier. The returned Goods should be delivered or sent to the following address: Yogattractive. Paryska 17/17 03-945 Warsaw

11 The Seller may withhold the refund to the Customer until the Goods are returned or the Customer provides proof of their return, whichever occurs first.

12 The right to withdraw from the Sales Agreement does not apply to Customers who are Consumers in relation to agreements in which the Goods are items delivered in sealed packaging which, once opened, cannot be returned for health or hygiene reasons, if the packaging was opened after delivery.

13 Until the Goods are collected, the Customer has the contractual right to withdraw from the Sales Agreement in accordance with Article 395 of the Civil Code. The Customer may exercise this right by submitting a statement to the Seller. The above contractual right of withdrawal is independent and does not affect or limit the right to withdraw from the Agreement within 14 days under the Consumer Rights Act, described in points 1 and 2 above.

VII. TERMS AND CONDITIONS FOR TERMINATION OF THE SALES AGREEMENT BY THE SELLER

1 If the Customer chooses to pay via PayU or Tpay, the Seller may withdraw from the Sales Agreement if the payment is not credited to their account within 7 days of the date of conclusion of the Sales Agreement.

2. The Seller's statement of withdrawal from the Sales Agreement shall be sent to the Customer by email.

VIII. COMPLAINT PROCEDURE FOR GOODS

1 The Seller shall be liable to the Customer (who is a consumer within the meaning of Article 22[1] of the Civil Code) under the warranty for defects to the extent specified in the Civil Code.

2. If the Goods are defective, the Customer may:

a submit a statement on price reduction or withdrawal from the Sales Agreement, unless the Seller immediately and without undue inconvenience to the Customer replaces the defective Goods with non-defective ones.

b This limitation shall not apply if the Goods have already been replaced by the Seller or if the Seller has failed to fulfill its obligation to replace the Goods with Goods free from defects.

c demand replacement of the defective Goods with Goods free from defects. The Seller is obliged to replace the defective Goods with Goods free from defects within a reasonable time without undue inconvenience to the Customer.

3 The Seller may refuse to satisfy the Customer's request if bringing the defective Goods into compliance with the Sales Agreement in the manner chosen by the Customer is impossible or would involve excessive costs compared to the other possible method of bringing the Goods into compliance with the Sales Agreement. The costs of replacement shall be borne by the Seller.

4 Complaints should be sent to the following address of the Seller's warehouses: Yogattractive Paryska 17/17 03-945 Warsaw or by email toshop@yogattractive.com. The Seller will consider them within 14 days.

5. In the case of a Customer who is a Consumer, the cost of delivering the Goods subject to complaint shall be covered by the Seller.

6 Personal care products sold in sealed packaging, such as galvanic rollers, cannot be returned once the packaging has been opened.

COMPLAINT PROCEDURE FOR ELECTRONIC SERVICES

1 The Seller ensures that it will take measures to ensure that the Store operates correctly, taking into account the current state of technical knowledge and the hardware and software used, removing any irregularities reported by Customers.

2 The Customer may submit a complaint to the Seller regarding irregularities related to the functioning of the Store. Customers may submit complaints in writing to the Seller's address (Yogattractive. Paryska 17/17 03-945 Warsaw) or to the following address:shop@Yogattractive.com, providing a description of the irregularities and the date on which they occurred.

3. The Seller undertakes to consider each such complaint within 14 days or within another period of time, about which it will inform the Customer. The Seller will remove the indicated irregularities in the shortest time technically possible.

TECHNICAL REQUIREMENTS FOR EQUIPMENT USED BY THE CUSTOMER

1 In order to make a purchase in the Store, the Customer should have access to a computer workstation or terminal device with Internet access.

2 These devices must meet the following minimum technical requirements:

a Internet Explorer version MSIE 8.x or newer,

b Firefox version 7.x or newer,

c Chrome 15.x,

d minimum screen resolution of 1024 x 768 pixels.

XI. ADDITIONAL COMMERCIAL INFORMATION

The Seller shall inform Customers on its websites about current promotional activities, including price reductions or other benefits related to the promoted Goods, specifying their duration and the conditions necessary to take advantage of the promotion.

XII. ADDITIONAL (STATUTORY) PROHIBITION APPLICABLE TO THE BUYER

The Customer is obliged to comply with the statutory prohibition on placing illegal content in the Seller's ICT system, including content that is defamatory or infringes on the personal rights and other rights of third parties.

XIV. PROTECTION OF CUSTOMERS' PERSONAL DATA

1. The Seller is the Administrator of the personal data of Customers provided to the Seller voluntarily as part of the order placed.

2 The Seller processes Customers' personal data for the purpose of fulfilling orders. The data is processed solely on the basis of legal provisions or consent given by the Customer in accordance with applicable law.

3. The set of personal data provided to the Seller is reported by the Seller to the Inspector General for Personal Data Protection.

4. The Customer provides their personal data to the Seller voluntarily, with the proviso, however, that failure to provide certain data during the Registration process prevents Registration and the creation of a Customer Account, and prevents the placement and fulfillment of the Customer's order in the case of placing an order without registering a Customer Account.

5. Anyone who provides the Seller with their personal data has the right to access and correct it, or request its removal, and in cases provided for by law, request that the processing of their personal data be discontinued.

6 The Seller ensures the possibility of removing personal data from the database, in particular in the event of deleting the Customer's Account. The Seller may refuse to delete personal data if the Customer has not settled all liabilities towards the Seller or has violated applicable law, and the retention of personal data is necessary to clarify these circumstances and determine the Customer's liability.

7. The Seller protects the personal data provided to it and makes every effort to secure it against unauthorized access or use by unauthorized persons.

8 The Seller shall transfer the Customer's personal data to the Supplier to the extent necessary to perform the Delivery.

XVI. FINAL PROVISIONS

1 It is not permissible to use the resources and functions of the Store for the purpose of conducting activities by the Customer that would violate the interests of the Seller.

2 All rights to the Store, including copyrights, intellectual property rights to its name, its Internet domain, the Store's website, as well as to the templates, forms, logos, and photos posted on the Store's website belong to the Seller or entities cooperating with it.

3 The Seller uses cookies, which are stored by the Seller's server on the hard drive of the Customer's end device when Customers use the Store's website. The use of cookies is intended to ensure the proper functioning of the Store's website on Customers' end devices. This mechanism does not damage the Customer's end device and does not cause any configuration changes in the Customers' end devices or in the software installed on these devices. Each Customer may disable the "cookies" mechanism in the web browser of their end device. The Seller points out that disabling "cookies" may, however, cause difficulties or prevent the use of the Store's website.

4 The Seller shall be liable for non-performance or improper performance of the Agreement, but in the case of agreements concluded with Customers who are Entrepreneurs, the Seller shall be liable only in the event of intentional damage and within the limits of the actual losses incurred by the Customer who is an Entrepreneur.

5 Any disputes arising between the Seller and the Customer who is a Consumer within the meaning of Article 22[1] of the Civil Code shall be settled by the courts having jurisdiction in accordance with the provisions of the Code of Civil Procedure.

6 Any disputes arising between the Seller and a Customer who is not a Consumer within the meaning of Article 22[1] of the Civil Code shall be settled by the court having jurisdiction over the Seller's registered office.

7 Customers who are Consumers may also use extrajudicial means of dealing with complaints and pursuing claims by submitting their complaint via the EU ODR online platform, available at:http://ec.europa.eu/consumers/odr/

8 In matters not covered by these Regulations, the provisions indicated in point I.3 of these Regulations shall apply.

9 The Seller reserves the right to amend these Terms and Conditions. All Orders accepted by the Seller for fulfillment before the date of entry into force of the new Terms and Conditions shall be fulfilled on the basis of the existing Terms and Conditions (which were in force at the time of conclusion of the Sales Agreement). The amended Terms and Conditions shall enter into force within 14 days of their publication on the Store's Website.

New: online courses
